What Happens During an Aviation Accident Investigation?
With decades of aviation experience, most people affected by aviation mishaps almost always arrive with the same question.
What happened.
It comes first for a reason, and the answer is hard to sit with: it takes time to know. Not because anyone is withholding it, but because the answers get assembled from pieces of information that arrive separately. The wreckage. The maintenance logs. The weather that day. The radio traffic. The decisions made in the cockpit.
So here is what actually happens during an aviation accident investigation: who runs it, how long it takes, and why the federal investigation answers a different question than the one about who is legally responsible.
Who investigates an aviation accident?
For civil aviation accidents in the United States, the National Transportation Safety Board (NTSB) is the federal agency that investigates and determines probable cause.
Depending on the accident, the NTSB brings in specialists across aircraft systems, operations, human performance, weather, air traffic control, and maintenance.
The Federal Aviation Administration (FAA) often participates as well, with a different role. The NTSB investigates. The FAA regulates civil aviation and enforces federal safety requirements.
That difference matters more than it sounds, and we spend real time on it early in a case. Families reasonably assume that if two federal agencies are involved, somebody is looking out for their interests. Two federal agencies, two different jobs, and neither one is working on your claim.
Step 1: The scene and the wreckage
The first priority is to gather and preserve evidence.
Investigators document where the aircraft and its components came to rest, examine the wreckage, photograph the scene, and identify parts that need further testing. Where the pieces landed tells part of the story. What the metal looks like in a laboratory tells another part.
Evidence at the scene may indicate structural damage, mechanical problems, fire, or other conditions that warrant closer inspection.
The work continues after the wreckage leaves the site. Investigators take components to laboratories and other facilities for detailed examination.
Step 2: The paper trail
Physical evidence is only part of the picture. Investigators also review:
- Maintenance and inspection records
- Pilot training and qualification records
- Flight plans and logs
- Weather information
- Air traffic control communications
- Radar and flight tracking data
- Witness statements
- Aircraft and component histories
- Cockpit voice and flight data recordings, where available
Nobody is looking for the one document that explains everything. It is the comparison that matters, and the useful moment is usually where two sources disagree.
A maintenance write-up that reads as routine on paper can become central once it lines up with damage found in that exact component.
Step 3: Human, mechanical, and environmental factors
Aviation accidents rarely have a single cause. They usually have a chain, and the common causes of aviation accidents tend to overlap rather than stand alone.
Human factors are the part people outside aviation underestimate, and it is the part I was trained to look at: pilot decision-making, training, fatigue, communication, situational awareness, and how a crew responded as conditions changed.
Investigators also examine mechanical factors, including engines, flight controls, avionics, structural components, and other aircraft systems.
And they examine the environment: weather, visibility, wind, terrain, and airport or runway conditions.
Considering all three together is what separates a reconstruction from the theory everyone had in the first 48 hours. The explanation that seems obvious immediately after an accident often does not withstand scrutiny of the evidence.
Step 4: Technical analysis and testing
Engines, electronic systems, damaged components, and recorded data undergo specialized testing to determine whether a failure occurred and, if so, why.
The NTSB may also grant party status to manufacturers, aircraft operators, government agencies, and other organizations with relevant technical knowledge. In practice, massive companies with potential legal exposure are often in the room while the technical work is being done.
That is worth sitting with, and it is one reason we want our own eyes on that material rather than waiting to read about it in a report a year later.
Step 5: From preliminary findings to the final report
Some information emerges soon after an accident, but early findings rarely tell the whole story.
Investigators need time to review records, test components, interview witnesses, and reconcile conflicting evidence. Depending on the accident’s complexity, reaching a final conclusion can take months or longer.
At the end of its investigation, the NTSB issues a final report that describes the accident, analyzes the evidence, and identifies the probable cause. When investigators identify changes that could help prevent a similar accident, they issue safety recommendations.
Does the NTSB decide who is legally responsible?
No, and this distinction matters more than almost anything else here.
The NTSB investigates and determines probable cause. It does not decide who owes compensation in a civil claim.
Legal responsibility is a separate question. Depending on the circumstances, a civil aviation case may involve examining the conduct of pilots, aircraft operators, maintenance providers, manufacturers, or other parties whose actions contributed to the accident.
Injured passengers and families should not assume they need to wait for the entire federal investigation to conclude before learning about their legal options. In fatal accidents, families may also be weighing questions involving aviation wrongful death claims.
Why the timeline matters
The NTSB works on its own schedule. Evidence does not wait for it. Wreckage is eventually released. Aircraft return to service. Maintenance records stay with the company that created them. Witnesses move, and memories soften.
Much of what a case depends on sits under someone else’s control from day one.
Involving counsel early is not about rushing a claim. It is about ensuring that records and evidence still exist when the questions are finally asked. The deadlines that apply to aviation claims also vary depending on the type of accident and the parties involved, which, in itself, is a reason not to wait.

An aviation case involves more than the accident itself. Flight data, maintenance records, federal regulations, and technical reports all carry weight, and knowing how to read them changes how a case looks.
